See below - giving greater rights for tenants.
Critics have warned the reforms risked leaving landlords without a means to evict problem tenants.
A report by UK Finance says landlords have faced a challenging environment since 2016, when a stamp duty surcharge on additional properties was introduced.
They are also no longer entitled to the progressive removal of higher-rate income tax relief on mortgage interest payments for rentals.

Data from UK Finance showed the number of outstanding mortgages to landlords has fallen for the first time since 1996, when bespoke loans for property investors were first introduced.

The Tories have already had it in for landlords, these Labour measures will drive more people away from renting out properties.

Rang giles to book meeting with him and he has now sent out title plans
norman responded that his solicitor has got documents. he will goto faversham to sign stuff so hopefully his side will agree and his sale can commence. Apparently peter is bragging about holding up the process which of course he has been as he has not talked to giles
norman has suggested that the water trench can be dug by local guy john shrubshaw who has a 1.5 tonner digger. He did some work for norman last sunday. he is quick. will need to get peter to move his stuff down johns bit of land by a certain date else will move and dispose of the stuff to do this and he will have to foot the bill. once norman has purchased his house peter will need to empty out his garage with ultimation from debs.

re the memorial bit. Peter needs to get a fence up else norman and jamie will do this with stock fencing with pig netting. jamie can build the gate. They could put up internally a chestnut paling fence to make it a little prettier. normans bench is 70 inches by 19 inches deep. instead of creating a concrete base norman has a couple of lengths 10x6 18ft lengths which can be cut into 2 4ft lengths for the bench to fixed to. norman thinks this will take about half a day with jamies help. Norman has a post hitter. me and jamie need to check out mark out the boundaries and take pictures then visit norman at his work.

Thanks Cathy. Our client may want to carry out development in the future as detailed by him below. However, this will be changes to the house itself and not to the external access points for which easement cover is sought. Please advise if and how this changes the proposed indemnity cover. In case relevant we would note the property is a listed building.

In decreasing order of importance 1) insert a door in the eastern elevation for direct garden access from the kitchen; 2) an attic conversion in the long term; 3) a basement extension in the very long term if and only if it can be done in such a way that the property value increase offsets the cost. I should clarify that at this time I merely aspire to potentially do these things down the line as/when it is opportune for me to attempt such developments. If it makes a difference, I could no doubt commit to doing no work for a certain amount of time—as I won't have the funds for any of this immediately anyway.

GENERAL:

We do not offer advice about the problem that has been identified and for which you are seeking cover, nor on the suitability of the insurance, but have arranged the following premium quotation in response to your proposal and relying on the information that has been provided to us. Please note that any insurance that is offered will not formally bind until all the conditions set out in the quotation, and any subsequent correspondence, have been met.

Please also note that there is a Duty of Fair Presentation that applies when requests for insurance are made. You should carry out reasonable research into and make reasonable enquiries about the circumstances surrounding and pertaining to the concern for which insurance is sought and any information and/or representations, which might influence the Insurer’s judgement or decision, must be disclosed. For example, any problems, disputes, approaches to or communication with third parties, or other similar issues, that relate to or might impact on the risk are deemed to be material to our consideration and must be declared. Non-disclosure could compromise or invalidate any premium quotation or insurance that is arranged.

Please also note that we are an underwriting agency (not an insurance broker) acting on behalf of our insurer principal, Liberty Legal Indemnities at (Liberty Mutual Insurance Europe SE). We do not act for any other insurer and are unable to seek terms for this risk from any other insurer.

PREMIUM:
Liberty Legal Indemnities have quoted a single premium of £165, plus Insurance Premium Tax of £19.80, making a total of £184.80, for a policy in this case with a limit of liability of £670,000, with the policy to be in favour of the buyers to include successors in title and any mortgagees of the property.

At no additional charge Liberty will include an escalator provision under which the limit of liability under the policy will increase by the amount of £67,000 (amount equivalent to 10% of the original limit of liability) on each anniversary of the DATE OF COMMENCEMENT up to the maximum sum shown on the enclosed draft Schedule.

COVER:

The full cover will be as shown in the enclosed draft policy and is based on the continuation of the existing use of the property as currently developed. The key feature is to defend the insured’s position should a third party seek to prevent the insured from exercising a right of way over the access route(s) described in the draft Schedule.

Also enclosed is our Insurance Product Information and Status Disclosure Document. Please let us know if you have any query regarding the same.

REQUIREMENTS:

The quotation is subject to:

no approach being made or having been made to any third parties about or in connection with the potential lack of a right of way over the relevant parcel of land or with a view to establishing who might own it. Any such approaches may compromise, or render invalid, the premium quotation and any policy issued pursuant thereto.
a satisfactory statement of truth by the current owner confirming the free and uninterrupted use of the access route(s) during their period of ownership, without permission from, payment to or dispute with any third party. Please forward a draft referring to a clear plan for approval before it is finalised.

VALIDITY and INCEPTION

The quotation is valid for 6 months from the date of this email. However, should there be any change in the circumstances relating to the risk during that period and before cover commences you must notify us of that change in writing and the insurers reserve the right to amend or withdraw the quotation depending upon their consideration of that change. To take up the policy after the period has expired you will need to revert to us to see if the quotation can be renewed and whether the same terms will apply.

Cover will commence from the date of exchange of contracts, or a subsequent date of your choosing, subject to the under-mentioned being forwarded to us within 14 days thereafter:

Dear Sirs

Please can you provide a quote for potential lack of easements indemnity in relation to the following:-

Our client is seeking to purchase the attached freehold title, 4 Montague House. The title register and title plan for the property are attached.

The property formally formed part of the adjoining property, which is a building containing three flats, known as 1-3 Montague House.


The current seller previously owned a long lease of number 4, but she bought out the freehold in 2008. A copy of the deed of transfer from 2008 is also attached for reference.

Although the 2008 transfer granted and reserved various rights, there are two specific rights which number 4 enjoys but which are not referred to within the 2008 transfer. It is possible that the generic wording in clause 13.1 of the transfer would cover these rights, but we wish to have title insurance to cover the fact that there are no express rights in relation to the following two specific issues:-

At the rear of number 4 are French doors which lead onto a concrete area, and from there one goes along some steps which lead to number 4’s actual back garden. It is not clear whether the title plan shows the access steps (between the concrete area and the back garden) as being included within the seller’s title. The position is of the access steps is roughly shown by a blue arrow on the attached plan; and
It seems that the access gate from the roadway at the front is not within the seller’s title, nor is the small area of land that one has to go onto when walking through the entrance gate. Once inside, you then immediately turn left into the seller’s title. We attach a photo which shows by a red line the boundary between the two properties (number 4 being on the left, with1-3 Montague House being on the right of the red line). You can see from the photo how the entrance gate and the land in front of it are not on the number 4 side. The position of the gate is shown approximately by the red arrow on the attached plan.

Please confirm if you can provide a lack of easements indemnity to cover the above risks, with a limit of indemnity of £670,000.


For your information, the purchaser (for whom we are acting) has been the tenant at the property, and remains so. He is therefore aware of the fact that these two access points have been used without objection, but obviously now that he is purchasing the property we want to have these rights better cemented by way of an indemnity policy.
